How to exclude a driver from your insurance

Ontario offers auto insurance endorsement forms OPCF 28 Reducing Coverage for Named Persons and OPCF 28A Excluded Driver to help drivers customize their policy by removing someone they live with who is increasing their insurance premiums.

Typically, your car insurance policy extends coverage to you and any household members who may occasionally operate your vehicle. However, if someone living with you has a poor driving record, their presence could cause your premiums to increase.

With clearly defined rules in place, insurers may offer these endorsements to eligible policyholders. Here's how OPCF 28 and OPCF 28A can alter your policy and what they mean for an excluded driver.

What you need to know about OPCF 28 and 28A

  • OPCF 28 and 28A endorsements can lower insurance premiums by excluding a specific driver from your policy.

  • OPCF 28 offers limited liability coverage for the excluded driver, with customizable limits and deductibles, while OPCF 28A provides no insurance coverage.

  • Although you may save on premiums, OPCF 28A leaves the excluded driver completely uninsured and legally vulnerable if they operate the vehicle.

What does an excluded driver mean?

An excluded driver is someone you intentionally remove from your Ontario car insurance policy. If that person drives your vehicle, with or without your permission, and is involved in an accident, the claim may not be covered.

Excluding someone from your policy may be necessary if they have accumulated multiple accidents or traffic convictions. Removing them can potentially help reduce your insurance costs. Remember, auto insurance primarily covers the vehicle, but insurers also assess the risk posed by drivers in the household.

How do OPCF 28 and 28A work?

The policyholder must sign the government-approved OPCF 28: Reducing Coverage for Named Persons or OPCF 28A: Excluded Driver form, confirming that the excluded driver will not operate the insured vehicle.

Both the vehicle owner and the excluded driver must acknowledge that the insurer will not pay for damages to property, vehicle damage, or injuries caused by the excluded driver while operating the vehicle.

When these endorsements are active:

  • The policy will not provide coverage for the excluded driver while operating the insured vehicle.

  • The policy will not cover injuries or damages caused by the excluded driver.

  • The vehicle owner and excluded driver may be personally liable for damages or injuries resulting from an accident.

  • The excluded driver cannot receive most standard accident benefits while driving the insured vehicle.

  • The excluded driver may still be covered as a passenger, but not as a driver of the vehicle.

What is the difference between OPCF 28 and OPCF 28A?

OPCF 28 reduces coverage for a named driver, while OPCF 28A completely excludes the driver from coverage while operating the insured vehicle.

The key difference is that OPCF 28 may allow for limited liability protection and customizable coverage limits and deductibles. OPCF 28A, on the other hand, removes all insurance coverage required for that individual to legally drive the insured vehicle.

Example of OPCF 28

After graduating from university in Vancouver, Sarah returns permanently to Toronto to live with her father, David. David owns a 2022 Toyota Prius and adds Sarah as an occasional driver on his insurance policy.

Two months later, Sarah is found at fault in an accident involving her father's vehicle. The insurer classifies her as a higher-risk driver, resulting in a significant premium increase. Because the added cost becomes unaffordable, David asks his insurer to exclude Sarah from the policy.

If Sarah drives the vehicle after being excluded and causes an accident, neither she nor David may have insurance coverage for resulting damages, and both could be held personally responsible.

What does OPCF 28A cover?

Once the endorsement is signed and active, the named driver is excluded from coverage under the policy while driving the vehicle.

  • No accident benefits coverage will apply to the excluded driver.

  • If the excluded driver is caught operating the vehicle, they may face charges for driving without insurance.

  • The vehicle owner and excluded driver can be held personally responsible for damages or injuries caused while the driver is operating the vehicle.

Will OPCF 28 affect your costs?

In many cases, signing an OPCF 28 or OPCF 28A endorsement can reduce your insurance premiums because the insurer is no longer assessing the risk associated with the excluded driver.

However, insurers may still consider the excluded driver's past accidents or driving history when determining overall policy risk.

How long is a driver excluded from a car insurance policy?

The exclusion remains in effect until the policyholder requests its removal and the insurer agrees to reinstate the driver. Reinstatement is not automatic and is typically based on the excluded driver's risk profile at the time of the request.

In many situations, policyholders wait until previous at-fault accidents or convictions have aged off the driver's record before seeking reinstatement.

What happens if an excluded driver gets in an accident?

If an excluded driver is involved in an accident while operating a vehicle covered by your policy, both you and the excluded driver could be sued for damages or injuries resulting from the collision.

Your insurer may deny coverage if the excluded driver was operating the vehicle with your knowledge or permission. Whether the excluded driver was at fault or not, the exclusion can have serious legal and financial consequences.
